GENERAL TERMS AND CONDITIONS OF PARTICIPATION

I. Vype “Tell a Friend” referral programme

Have you tried our new Vype ePen3, and did you love the experience? Tell your friends about it if they might be interested in Vype. Use our “Tell a Friend” referral programme and you will both enjoy the benefits (discounts and free gifts). 

RULES:

1. Entry is free. No purchase is necessary.

2. To enter and to be able to refer a friend under the “Tell a Friend” programme, the participant (hereinafter the “participant”) must open a personal account at govype.ch and agree to the terms and conditions of entry at www.govype.ch.

3. Entry to the “Tell a Friend” programme is intended solely for tobacco consumers aged over 18 and resident in Switzerland, and is reserved for those who have registered on the site www.govype.ch. Employees of British American Tobacco (hereinafter referred to as BAT), BAT Vending and any subsidiaries of the BAT Group in Switzerland or elsewhere in the world, together with members of their families, are not eligible to participate in this programme.

4. To participate in the “Tell a Friend” programme, the participant must sign into their account at www.govype.ch and go to the “Vype Club” tab, then “Refer a Friend”. The participant must then:

• log into their account on govype.ch,
• fill in the “Invite a friend” form, providing:
the name of the participant,
the email address of the participant,
the name of the friend they would like to refer,
the email address of the friend they would like to refer.

5. Once this information has been completed, the friend referred by the participant will receive an email containing the participant’s personal code which will give them access to a 50% discount off the retail price of a Vype ePen3 Starter Kit from www.govype.ch. 
The referred friend will then have to create an account at govype.ch and confirm their age and that they are a nicotine consumer. They can then place their order and when they finalise it, enter the participant’s personal code in the space provided to benefit from the aforementioned discount.

6. Once the order has been validated, the participant will receive a confirmation email stating that their friend has used their personal code. They will then receive a code by email entitling them to a free pack of 2 pods of their choice, valid on their next order from www.govype.ch.

For the referral to be valid, the following conditions must be met:

• The friend to be referred must not have previously registered with www.govype.ch.
• The friend referred must register on www.govype.ch using the same email address that the participant used to invite them. 
• The friend must finalise their order for a starter kit using the participant’s code at www.govype.ch.

7. Prizes may not be exchanged and there are no cash alternatives. The code may only be used once and may not be transferred to a third party. The participant may refer as many friends as they wish who may be interested in Vype, but the referral will only be valid if the referred friend has not previously registered with www.govype.ch.

8. Furthermore, BAT reserves the right to terminate the “Tell a Friend” referral programme at any time, at its discretion. The cessation of any such competition does not imply any right to compensation of any kind. No rights are acquired and no service may be demanded. Furthermore, we accept no liability if the data entered in the forms or members’ emails are not recognised by the system or, more generally, if a person is prevented from participating in a competition due to a technical or other error. We also reserve the right to exclude participants from the draw. This applies in particular to participants who deceive or seek to deceive (creation of multiple participant accounts) or participants who violate the terms and conditions of participation.

All decisions are final and may not be subject to any complaint or recourse.

9. When they complete the registration form to enter the draw, participants are asked to provide certain personal information (forename, surname, email address). This personal information will be held in Switzerland and Ireland and will be used for the purpose of participation in the draw and its administration, and for marketing purposes. Participants’ personal information will only be passed on to third parties if necessary for the administration of the draw and provision of the prize. BAT will ensure that these third parties process this personal information only as authorised by BAT. Participants may contact BAT (info(at)govype.ch) if they have any questions concerning the processing of personal information.

10. By participating in the draw, participants consent to BAT using their email address to send them electronic newsletters. The newsletter may be cancelled at any time.

11. BAT reserves the right to modify these conditions of participation at any time. Consequently the general terms and conditions of participation applicable are those in force at www.govype.ch on the day on which any dispute arises.

General Conditions

Tell a Friend activities programme (TAF programme):

Anyone who registers at www.govype.ch with the intention of participating in a game or draw further to the invitation received by a person (already registered at www.govype.ch) as part of the “Tell a Friend” programme agrees that the latter may be informed of their registration and use of the promotional code they received as part of this process.
